Franchisor Prevails in Trademark Infringement and Franchise Agreement Claims Against Franchisee

A Federal District Judge in Oklahoma City, Oklahoma has entered judgment in favor of Pizza Inn, Inc. in a long-running dispute with an Oklahoma restaurant franchisee who continued to operate “Pizza Inn” branded restaurants in two locations in Oklahoma after the termination of the franchise agreements. Pizza Inn argued that continued operation violated the Lanham Act in utilizing the Pizza Inn trademarks without a license and the non-compete provisions of the franchise agreement. The Court entered an injunction against the franchisee and awarded damages in excess of $187,000.00. Pizza Inn, Inc. was represented by Cody Towns and Elizabeth Gebert of Towns Law Firm.
